REPORTS ON COURT CASES-NEWS FROM CIRCLE.

1.Our extra increment case came and argument was over  and reserved  for judgement. May be expected in 2 to 3 days. Most likely DOT may be directed to issue speaking order on our representation. 
Our Circle president Com.V.Ramarao and Circle Vice president Com.A.Sugumaran had gone to Court from our Union side who have reported the above.



 Our Pension Anomaly case was listed today in Delhi High Court before the Division Bench in Court No.8, at Item No.4 
 Preliminary hearing took place from both sides on the Writ Petition Titled UOI & ORS   V/S  AIBSNLPWA & ORS , challenging the Order dated 16.12.2016 passed by Principal Bench  of CAT ND in our favour. The Honourable Court said that this csse will require more time for hearing both the sides.
 The next date for hearing has been fixed on 22.10.2018.


Our Advocate requested for some early date . But the Court did not agree to change the date of next hearing.
Let us hope for the best.

Tail Piece :  Justice delayed is justice denied. Great honourable judges are least bothered of this delaying and denying. Ordinary people are helpless.
All are not equal before  the Judges.

3   Today Com. PSR, Com.DG, Com. R N Padanair and Com. George ( Circle Secretary Kerala) met Advocate Sriraj at Ernakulam and discussed about filing the two cases as decided in Patna CWC. Advocate's initial reaction was that those two cases could be filed on behalf of our association and few others from Kerala. Com PSR can sign on behalf of CHQ. We have handed over the relevant material to him. He would study and prepare the petition and it could be filed within two weeks of time. Affected members list from Kerala can be annexed. When it goes to Apex court level affected members list from other states can be added.
We discussed with the advocate for more than an hour and he has knowledge about service matters and understood the issue with sharpness.

Change is the rule of Life. We have to adjust with and adapt to the changing situations. Some of us joined the P&T Department, moved to Department of Telecom and finally to BSNL. We joined Government Services and retired from Public Sector Company. These changes brought some problems too. We were assured on behalf of President of India, that Government would directly pay pension to us. At the same time, a mischievous thought clause was inserted in the rule that the company would share the responsibility to pay pension. Now, with annulment of 60:40 sharing ratio, it is 100% responsibility of the Government. First, the BSNL was considered as pension sanctioning authority. Now it is declared that CCA is the pension sanctioning authority for BSNL retirees. Naturally, CCA offices are directed to collect the service Books of all and keep them in safe custody. It is proposed that CCA offices shall directly credit the pension amount with DA in the accounts of pensioners. In short the CCA shall be Pension Sanctioning Authority, Pension Authorisation Authority and also Pension Disbursement Authority. BSNL has only to forward the documents to CCA at the time when a staff retires. Delay in Post Offices in granting revised rates of IDA can be avoided. In effect BSNL retirees are recognized as Central Government Pensioners.
We welcome these changes with some concern. Some CCA offices have exhibited their inability in handling such a volume of work. Large number of cases of pension revision with 78.2% IDA is still pending in some circles like NTR, Kerala, West Bengal. It is not because of in efficiency. Some of these offices intentionally floated the instructions from Directorate. Some showed extra efficiency in asking unwanted queries and the Directorate failed to intervene properly. Processing, sanctioning, and disbursing pension as well as up keeping the records of about 3 lakhs BSNL retirees and one lakh DOT pensioners shall be a major work of CCA offices. When additional work is given to them, sufficient staff should be provided. Proper training should be imparted to the Officers and Staff in CCA offices to take the challenging responsibility. Entire administrative set up in CCA offices has to be revamped. Prompt action should be taken to digitalise all documents concerning pension, which will reduce space problem. More than anything, the mind set up should be changed. We hope that Telecom Commission will urgently address these issues with due seriousness. It should be ensured that all its instructions are properly and promptly compiled with.

Hard and Planned Strategic work, Timely help and Assistance to the Needy people, Courteous approach , Intensive Canvassing,  Good Guiding by the Leadership ,Team work of all Members have yielded the Result.
The Membership has increased in an enviable level.
MADURAI:-  From 01-04-2017 to Till date, 152 New Members have been added. 
Total Membership Strength as of Today is  : 1650.
COIMBATORE :- From 01-06-2017 to Till Date, 103 New Members have been added.
Total membership Strength as of Today is : 686

DPE HAS ISSUED TWO ORDERS TODAY.
1. FOR THOSE WHO GOT LAST PAY/PENSION REVISION W.E.F 1-1-2007 LIKE BSNL EMPLOYEES AND BSNL PENSIONERS.
2. FOR THOSE WHO GOT PAY REVISION LATEST W.E.F. 1-1-2017.

BSNL Corporate Office has issued an order today, 01-01-2018. For those who avail BSNLMRS with voucher for outdoor treatment, hitherto the ceiling was fixed at 25 days pay with 68.8% IDA. According to today’s order, 78.2% IDA is allowed in the place of 68.8%. Good.
At the same time, eligibility ceiling is limited to 23 days’ pay instead of 25 days.
What is the net effect?
Take an employee with Rs 10000 Basic Pay,for easy calculation.
25 days’ Basic Pay plus 68.8% IDA: Rs 14066.00
23 days’ Basic pay plus 78.2% IDA: Rs 13662.00
