ANOMALY CASE: JUDGEMENT WHEN?
We have already informed that the Arguments are over and Judgment is reserved.Some pensioners are asking us how much time it will take?
The case was heard by a division bench consisting of two judges in CAT, Principal Bench. It is sure they have taken a decision. Other things are formality only. One judge will dictate the full judgment to the stenographer.He will type it and show the draft.The Judge will correct and approve a final draft. Again, it will be shown to the other judge. After he approves it the final copy will be drawn.Then it will be signed by all concerned and released.
This process may take two weeks, two months or even more. We can not say. I personally expect it only after the Christmas Holidays are over.
Anyway the case is a decade old. Nobody else could take it to the culmination. We have done it. We have waited all these years. Let us wait for few more days….

"We will soon be approaching the third Pay Revision Committee (PRC) with concrete suggestions on having performance-related pay for BSNL," Bharat Sanchar Nigam Ltd's Chairman and Managing Director Anupam Shrivastava told .
"We have already made one round of presentation before PRC in October, in which we touched upon this aspect. At the same time, we are discussing it with employee associations and unions," he added.Currently the salary has a component of PSU profitability built into it, Shrivastava said.
BSNL has started clocking operating profit and is firmly on a path to profitability, he said. "We would like to have performance related pay which can truly be attributed to performance of an individual and it should be different from the performance of the PSU."
On the proposal that is taking shape, he said: "We are saying that apart from the fixed pay, there should also be a component of performance-related pay which again will have both fixed and variable elements. The fixed part will be given to all and variable to individuals and groups who have outperformed."
BSNL will consult 6-7 associations and unions, including majority unions (both for non executive employees and officers), to ensure their "participation in a substantial manner to the discussion", Shrivastava said.
Telecom Minister Manoj Sinha has earlier asked the firm to consider implementing 'performance related pay'.In September-end, the minister had asked BSNL to consider such a proposal saying that the workers need to come out of the mindset that salary will be paid on the first day of each month "whether or not work is done"."Good workers need to be certainly rewarded...but the mindset that salary will come on the first day of the month whether or not work is done...one needs to come out of that mindset," the minister had said.………………………. Let us be grateful
Many employees or Pensioners used to criticize even abuse the unions for not getting some issues settled. They do not criticize the authorities who are responsible for the delay or denial of justice. After the issues are settled, it is a habit of many to state that “Even otherwise it would have come.” It is but human nature.
As elderly people with lot of experience in our service, we should not behave so irresponsibly. We have seen how issues are settled and demands are achieved. We should be grateful to Late Mr. D S Nakara (1914-2009) for his great service to the pensioners of India by filing a case against injustice with farsightedness. Many people have gone to Court and won their cases.Supreme Court of India delivered thousands of judgements in favour of pensioners. Then, how Nakara Case Judgement became a magnacarta for Indian Pensioners?
Only because late Mr. Nakara raised many fundamental, basic issues concerning the pension system in his affidavit in the case. Court had to address those issues because they were raised in the Application. Do not ignore this aspect.
We must remember also Late Mr. H D Shourie, the man who fought many a cases of common nature. Mr. Shourie formed a platform called COMMON CAUSE for fighting the legal battles in Courts of law. He helped Mr. Nakara in preparing the Affidavit.
All of us – all the pensioners of BSNL, Central Government, State Governments etc etc. – are enjoying the fruits of their labour and wisdom. When we observe the Pensioners Day, let us remember both Mr. Nakara and Mr. Shourie…
