According to the official information, 10397 cases are still pending as on 31-7-2017 for pension revision with 78.2% IDR benefit. Total number of BSNL pensioners retired before 10-6-2013 is 133535. Out of that, 123138 cases have been settled. BSNL offices have not yet forwarded 7675 cases. CCA offices have sent back 2196 cases for various reasons. So, total cases pending with BSNL offices is 9871. 526 cases are pending with CCA offices also.

[We can not take the above figures as correct or perfect. DoT had released a statement in March 2017 showing the Circle-wise figures as on 28-2-2017. According to that statement, the total number of pensioners was 139835. Whereas, this time it is shown as 133535. In Maharastra Circle, according to the previous statement there were 16121 pensioners. Now it is shown as 9428. This is the credibility of official information.... PSR.]

Ø We BSNL retirees want a regular and transparent system , a safe and sustainable system for our Pension Revision in future along with all other Central service pensioners of India. Every time the old pensioners should not be forced to knock and wait before Prime Minister’s door for pension revision.
Ø BSNL has to revise the wages. BSNL has no authority to revise PENSION. Government has to take a decision regarding Pension Revision. Government need not worry about affordability.
Ø We demand Pension Revision , independent of wage revision in BSNL. Pension should be revised de-linking it from the Profits/Loss of BSNL. It should be done based on Central Pay Commission Recommendations. We have submitted a memorandum to Shri.Manoj Sinha , the minister of state for Communications.
Ø Absorbed employees of BSNL have rendered most part of their service in DOT under Govt.Of India.
Ø Rule 37-A was incorporated in CCS (Pension) rules 1972 on 30-09-2000 ( one day prior to formation of BSNL) exclusively for BSNL retirees.
Ø As per explanation under sub-rule 8 of Rule 37-A “ The amount of Pension/Family Pension of the absorbed employee on retirement or on death from PSU shall be calculated in the same way as calculated in the case of a Central Govt. Servant retiring or dying on the same way.
Ø DOP&PW in its letter to DOT dt 27/3/2009 stated “ BSNL is the only PSU that has been granted a special dispensation under sub rule 21 of Rule 37-A to the effect that pensioner benefits including FP to the absorbed employees of BSNL is paid by the Govt.”
Ø The recommendations of 6th CPC like emoluments for pension, enhanced family pension, age-related additional pension application of new commutation table, ceiling of gratuity etc were made applicable to absorbed BSNL retirees w.e.f.01-01-2006. As per 7th CPC recommendation ,ceiling on gratuity was also raised to 20 Lakhs to BSNL IDA pensioners from 01-01-2016.
Ø The lower and upper ceiling on Pension/Family Pension is on par with C.G. Pensioner ( Pension Revision order dtd 15-03-2011 states that) The ceiling is not based on BSNL pay scales.
Ø All the three PRCs did not have “Pension Revision” in their terms of reference where as CPCs have.
Ø The CPC recommendations are implemented not only to CG pensioners but also to 69 CPSC retirees who are covered under CCS (Pension Rules) 1972 having CDA pattern.
Ø The orders issued by DoP&PW for implementation of CPC recommendations including the order dtd 04-08-2016 specifically states that it is applicable to Pensioners/FP covered under CCS(Pension) Rules 1972 and BSNL retirees are also coming under the same category.
Ø As per Apex Court order dated 03-05-1990, DPE issued guidelines that CPSEs started after 01-01-1989 shall have only IDA pattern and not CDA pattern. So DA pattern cannot be a reason to deny this benefit to BSNL retirees.
Ø On behalf of our Association, we sublitted a memorandum to VII CPC. Our Assistant General Secretary Shri.Gangadhara Rao gave oral evidence before the commission at Bangaluru on 24-07-2014. Justice Hon.A.K.Mathur, Chairman, VII CPC after going through our memorandum and after hearing the oral evidence, made a remark that there is a “Prima –facie” in our demand.
Ø During our discussion with shri.R.K.Garg, the then Secretary, Telecom on 04-08-2015, he assured that even if there is no specific recommendation from 7th CPC, on this demand, DOT shall take up this issue with nodal departments and ultimately Government may take a Policy Decision.
Ø We also had the opportunity to discuss this issue with chairman implementation cell of 7th CPC, Shri. R.K.Chaturvedi ( Jt.Secy. Dept of Expenditure) during the last week of February 2016. He also informed us that if a proposal with due justification, is sent by DOT, it can be considered positively.
Ø Now DOT has to take necessary initiative in this regard. If our demand is conceded now itself, it would be a permanent solution and a policy decision by the Government is required in this regard.

We are very glad to see the letter written by Shri K. Sebastin, General Secretary of Sanchar Nigam Executives ssociation (SNEA) of India to Secretary, Telecom on pension revision in BSNL. He demands pension revision delinked with PRC Report and affordability. He demands pension revision under CCS (Pension) Rule 1972. We welcome his demand.
Last time, the benefit given by Second PRC (30% of Basic Pay and 30% of DA then) was better than the benefit given by sixth CPC (40% of Basic Pension). So, it is nothing but natural that some comrades demanded PRC formula for our pension revision this time. They did not expect the ‘affordability’ condition. Realizing the situation, all are coming to the position of demanding pension revision in BSNL under CCS (Pension ) Rule, 1972.
Now, let all organizations representing BSNL retirees place one demand:
“Revise the Pension recognizing BSNL retirees as Central Service Pensioners receiving pension from Government of India under CCS (Pension) rule, 1972.”
This will ensure pension revision in future.This is a demand for not only the existing pensioners but for those who are in service now also. Next Pay/Pension revision will take place after ten years.Before that all those DOT employees absorbed in BSNL will retire from service. Hence we raise the demand for a permanent, sustainable system for pension revision as per CPC formula for all the 2.93 lakh DOT employees absorbed in BSNL – those who are already retired and those who will be retiring.
PENSION PAYING LIBAILITY IS 100% WITH GOVT.HENCE PENSION REVISION RESPONSIBILITY ALSO IS 100% WITH GOVT.

Pension revision for the retired BSNL Executives and Non Executives is not linked with the 3rd PRC or pay revision of the serving BSNL Executives or the affordability of BSNL.
Respected Madam,
BSNL was formed on 01.10.2000 by the corporatization of DTS/DTO and more than 3.5 lakhs Govt employees got absorbed in BSNL. Out of 3.5 lakhs, 2 lakhs employees already retired from the service. All of them got absorbed in BSNL on the firm commitment from the Govt that they will be paid Govt pension on IDA pay scales as per the provisions of CCS Pension Rules 1972. For this purpose, Govt amended the CCS Pension Rules 1972 by inserting Rule 37A, specifically for BSNL Pensioners. Like other Central Govt pensioners, pension for the BSNL pensioners also paid by the Govt.The last pension revision for BSNL Pensioners had done w.e.f. 01.01.2007, co-terminus with the date of pay revision for the Executives and Non Executives of the CPSUs. Next pension revision for the BSNL pensioners is due from 01.01.2017.
Pension revision for the BSNL pensioners is not linked with the 3rd PRC or pay revision of the serving BSNL Executives due to the following reasons:
1) Pension for the BSNL Pensioners is governed by Rule 37A of the CCS Pension Rules, 1972. Pension is paid by the Govt, not by BSNL.
2) Since Pension is paid by the Govt, affordability or profitability of BSNL is not at all affects the pension revision.
3) For the BSNL pensioners, the pension contribution as decided by the Govt is already paid in full by BSNL to the Govt, till their retirement.
4) 3rd PRC recommendation is only for pay revision unlike Central Pay Commission (CPC) where pay revision and pension revision were part of the terms of reference and recommendations of CPCs.
5) PRC is only for the Executives unlike the Central Pay Commission (CPC) where pay revision and pension revision were part of the terms of reference for all, officers as well as other employees.
6) Pension revision for BSNL pensioners was not part of terms of reference of 3rd PRC and hence no recommendation is given by 3rd PRC in this regard. Another reason is that 3rd PRC is only for the Executives, not for the Non-Executives.
7) Last pension revision for BSNL pensioners w.e.f 01.01.2007 was done through a Union Cabinet decision.
8) With regards to fitment, Union Cabinet already decided 15% fitment on IDA scales.In view of the above submissions, your kind personal intervention is solicited to take urgent steps to get the pension revision implemented for BSNL pensioner’s w.e.f. 01.01.2017 with 15% fitment, with the approval of Union Cabinet.

A PIONEER IN THE FORMATION PROCESS.
The function chaired by Com M.Raveendran, our Dist President had a gathering of more than 300 members including lady comrades all in joyous mood for having Com S. Sugumaran amidst us on this occasion.
After the prayer song by Smt. Kalyani Sundaresan,homage was paid to departed comrades.
Com. S Veerachamy extended a warm welcome to all.
Com GRD, read out the minutes of the last GB and Executive minutes and was approved by the house.
Com. G K Venkatesan who attended the AIFPA at Chennai presented a report on the same.
Com. S. Sundaresan our Dist vice president,narrated the activities of our dist branch with special ref to Adhalt cases.
Com Alagar from Dindigul, Com K Chandran from Theni felicitated.
Com Ammayappan, Secretary Postal Pensioners Assocication, Madurai ,a special invitee ,while speaking on the occasion commended our activities and stressed for unity among pensioners in light of the growing on going activities in the world against the pensioners . He also praised the modus operandi of our leaders in getting the best for the pensioners.
Our senior Com. Shunmugam presented shawls to our leaders and praised the way in which they are working for the welfare of the pensioners.

Narrated in detail the hectic process that paved the way for annulling the 60:40 condition for payment of pension and getting the benefit of 78.2% IDA merger.
Gave a detailed in sight of the recent developments in

He explained in detail why our association is pressing for pension revision through CPC and not through PRC as demanded by other rival associations earlier.
He stressed for necessity for strengthening our Pensioners association and requested all to contriute liberally as per CHQ guidelines for settling our just demands through court of law since we have no other go.

Our Legal wing secretary Com.R L Kapoor reports from Newdelhi that our contempt petition to ensure implementation and compliance order dated 16-12-2016 for pension anomaly case for those who retired between 01-102000 and 30-06-2001 was listed as item 6 coourt no 2 in CAT Principal Bench, NEW DELHI Today 16-08-2017 .

PROCESS INVOLVED IN PAYMENT OF MEDICAL ALLOWANCE WITHOUT VOUCHER.
SSAs should take immediate action to quicken the process of consolidation of Data and forward it to CGM Office immediately. In turn CGM Office will further consolidate SSA wise and will calculate the required amount and send to Corporate office. Then only the payment will take place. So all secretaries/other office bearers/Circle office bearers should act swiftly and execute the process.
